These Terms of Use ("Terms") govern your use of the DayDrift mobile application ("App"). By downloading or using the App, you agree to these Terms.
1. License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to use DayDrift for personal, non-commercial purposes in accordance with these Terms and applicable laws.
2. Free and Paid Features
Free Plan
- Limited to 7 incomplete todos
- Unlimited completed todos
- Local device storage only
Unlimited Plan
- Unlimited todos
- iCloud sync across devices
- Access to complete history
- Auto-renewable yearly subscription
3. Subscription Terms
Billing:
- Subscriptions are charged to your Apple ID account
- Payment is charged at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- All billing and refunds are managed through Apple; we do not process payments or issue refunds directly
Cancellation:
- You can cancel your subscription anytime through your Apple ID account settings
- Cancellation takes effect at the end of the current billing period
- No refunds for partial subscription periods
Price Changes:
- Subscription prices may change with notice
- Changes apply to subsequent subscription periods
- You'll be notified of price changes in advance
Refunds:
- All purchases are processed through Apple's App Store
- Refund requests must be made directly to Apple through the App Store
- We do not have access to or control over App Store refund policies
4. Acceptable Use
You agree to use DayDrift only for lawful purposes. You may not:
- Reverse engineer, decompile, or disassemble the App
- Attempt to gain unauthorized access to our systems
- Use the App to store illegal, harmful, or offensive content
- Interfere with or disrupt the App's functionality
- Violate any applicable laws or regulations
5. Your Content
- You retain all rights to the todo items and content you create in DayDrift
- You are solely responsible for your content
- We do not access, monitor, or claim ownership of your content
- You are responsible for maintaining backups of your data
6. Service Availability
No Warranty:
- DayDrift is provided "as is" and "as available"
- We do not guarantee the App will be error-free or uninterrupted
- We may modify, suspend, or discontinue features at any time without notice
- iCloud sync requires Apple's CloudKit service, which is beyond our control
Maintenance:
- We may perform maintenance that temporarily limits functionality
- We will attempt to minimize disruption but make no guarantees
7. Intellectual Property
- DayDrift and all related trademarks, logos, and content are owned by us
- These Terms do not grant you any rights to our intellectual property except as explicitly stated
8. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages
- We are not liable for data loss (maintain your own backups)
- Our total liability is limited to the amount you paid for the subscription in the past 12 months
- We are not responsible for Apple's services (iCloud, App Store, StoreKit)
9. Disclaimer of Warranties
- No warranty of merchantability or fitness for a particular purpose
- No warranty that the App will meet your requirements
- No warranty regarding third-party services (Apple iCloud, etc.)
10. Changes to Terms
- We may update these Terms at any time
- Continued use after changes constitutes acceptance
- Material changes will be notified through the App or via email if available
11. Termination
By You:
- You may stop using the App at any time
- Delete the App to terminate your use
- Cancel your subscription through Apple ID settings
By Us:
- We may terminate or suspend access for violations of these Terms
- We may discontinue the App at any time with or without notice
12. Privacy
Your use of DayDrift is also governed by our Privacy Policy, available at: ickas.dev/daydrift/privacy
13. Governing Law
These Terms are governed by the laws of Portugal, without regard to conflict of law principles.
14. Disputes Resolution
Any disputes arising from these Terms or your use of DayDrift shall be resolved through:
- Good faith negotiation
- If unresolved, binding arbitration in Portugal
- You waive any right to class action lawsuits
15. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
16. Entire Agreement
These Terms and the Privacy Policy constitute the entire agreement between you and us regarding DayDrift.
